Meralco has asked the courts to rule whether the rules issued by ERC to implement retail competition and open access (RCOA) in the Philippine electric power industry is valid. The country’s largest distribution utility was referring to the “contradiction” of the ERC resolutions and a DOE circular with Republic Act No. 9136, or the Electric Power Industry Reform Act (EPIRA) of 2001, and its implementing rules and regulations. Meralco said the circular and the two ERC resolutions “violate [Meralco’s] statutory right under Section 29 of the EPIRA… to engage in the business of supply of electricity” to the contestable market.
